Terms of Service

By accessing or using QR Think ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access the Service.

QR Think is a SaaS platform that provides AI-powered digital catalog and smart call solutions for businesses including restaurants, gyms, cinemas, retail stores, supermarkets, and hotels. The Service includes QR code-based customer interactions, digital menus and catalogs, order management, analytics dashboards, and AI-assisted features.

To use certain features, you must create an account. You agree to: - Provide accurate, current, and complete information - Maintain the security of your password and account - Promptly update your information if it changes - Accept responsibility for all activities under your account - Notify us immediately of any unauthorized access

The Service offers several subscription tiers: Trial, Starter, Pro, and Enterprise. Free trials are available for new accounts and are limited to 14 days. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. Billing is processed monthly through Authorize.Net. You authorize us to charge your payment method on file for recurring subscription fees. Prices are subject to change with 30 days notice.

You agree not to: - Use the Service for any illegal purpose - Upload content that is defamatory, obscene, or violates intellectual property rights - Attempt to gain unauthorized access to any part of the Service - Interfere with or disrupt the Service or servers - Use the Service to transmit malware or harmful code - Resell or redistribute the Service without authorization - Use automated means to access the Service beyond provided APIs

You retain ownership of all content you upload to the Service, including menu items, images, descriptions, and business information. By uploading content, you grant us a limited, non-exclusive license to display, process, and store your content solely for the purpose of providing the Service. We do not claim ownership of your data. You may export or delete your data at any time.

The Service includes AI-powered features for content generation, recommendations, and chatbot functionality. AI-generated content is provided "as-is" and may not always be accurate. You are responsible for reviewing and approving all AI-generated content before it is published. We are not liable for any inaccuracies in AI-generated content.

When your customers scan QR codes generated by the Service, they interact with your digital catalog. You are responsible for the accuracy of the information presented in your catalog, including prices, descriptions, allergen information, and availability. The Service provides the technical infrastructure but does not guarantee the accuracy of business-specific content.

We strive to maintain 99.9% uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance. We are not liable for interruptions caused by factors beyond our control, including but not limited to natural disasters, internet disruptions, or third-party service failures.

To the maximum extent permitted by law, QR Think and DESTEC Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless QR Think, DESTEC Solutions, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Either party may terminate the subscription at any time. Upon termination: - Your access to the Service will cease at the end of your current billing period - Your data will be retained for 30 days, after which it may be permanently deleted - No refunds will be provided for partial billing periods - We may terminate your account immediately for violation of these Terms

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
